Terms of Service for Bin There Bins

Welcome to Bin There Bins! These Terms of Service ("Terms") govern your access to and use of our services, including our website, mobile apps, and related products (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Eligibility

To use our Services, you must be at least 18 years old and capable of forming a binding contract. By using our Services, you represent and warrant that you meet these requirements.

2. Our Services

Bin There Bins offers a valet-style storage service. We deliver 27-gallon storage bins to your location, which you can pack and have us pick up for storage at our climate-controlled facility. You can view and manage your stored items via our customer portal (the "Binformation Center").

Key service features include:

  • Delivery and pickup of storage bins
  • 15-day grace period to pack and unpack bins
  • Storage billed monthly ($15 per bin, each bin in storage is billed as a full bin regardless of how full it is)
  • $15 refundable deposit per bin
  • Digital bin management and image uploads

3. Payment and Billing

  • Storage Billing Unit (Full Bin): Each physical bin that is picked up and checked into our facility is billed as one (1) full storage unit per month, regardless of how full it is. We do not offer partial-bin pricing or partial-month refunds upon removal.
  • When a Bin Is “In Storage”: A bin is considered “in storage” beginning on the calendar day it is picked up from you and checked into our facility, and it remains “in storage” until it is delivered back to you and checked out of storage.
  • Storage Fees: Billed on the 1st of each month at $15 per bin. Fees already billed for the month are not refunded if bins are removed before month-end.
  • Proration (for Mid-Month Start Only): If a bin first enters storage mid-month, a prorated storage fee for that initial partial month will be charged on the next month’s invoice.

    How we calculate proration:
    • Count the number of days remaining in the calendar month starting on (and including) the check-in/pickup day.
    • Divide that number by the total days in that month.
    • Multiply the result by the standard monthly storage rate of $15 per bin.
    Example: If a bin is picked up on the 20th of a 30-day month, there are 11 days remaining. Prorated charge = (11 ÷ 30) × $15 = $5.50. This prorated charge will be billed at the beginning of the following month, along with the full $15 charge for that upcoming month.
  • Deposit: A refundable $15 deposit per bin is charged when delivery is scheduled.
  • Pickup & Delivery Fees: $5 per bin, per direction. Applies to full bins only. Empty bin delivery and pickup are free.
  • Overweight Bins: Bins must not exceed 55 lbs. As stated in Section 5, overweight bins may incur an additional storage fee equal to the cost of one (1) bin per month.
  • Billing Method: Payments are processed via Stripe. You agree to maintain valid payment information on file.
  • Auto Pay & Authorization: By enabling Auto Pay, you authorize recurring monthly charges until you disable Auto Pay and all bins are removed from storage.
  • Late Payments: If your payment method fails, your account may be suspended. We may apply late fees and withhold bin access until the balance is cleared.
  • Delinquent Accounts and Abandoned Property: If payment is not made within fifteen (15) consecutive days of the due date, you will be in default under the Tennessee Self-Service Storage Facility Act. We will send written notice by verified email. The notice will include the amount due, a statement of our lien, and a demand for payment within at least thirty (30) days from the date of notice. The notice will also state that your stored property will be sold, donated, or otherwise disposed of in a commercially reasonable manner if the charges are not paid. If payment is still not made by the date stated in the notice, we may deny access to your property and proceed with sale, donation, or disposal not sooner than sixty (60) days after default. Sale proceeds will first be applied to outstanding charges; any surplus will be held for one (1) year, after which unclaimed funds will be remitted to the Tennessee State Treasurer. If property is donated or disposed of, no proceeds will be available, and the account will be closed once disposal is complete.

4. Refunds and Deposits

Deposits are refunded automatically once bins are returned in good condition. If a bin is damaged, lost, or not returned within 15 days of delivery (empty or full), your deposit will be forfeited. In such cases, ownership of the bin transfers to you, and the transaction is treated as if you purchased the bin outright. No further fees will apply in such cases.

5. Customer Responsibilities

You agree to:

  • Ensure bins do not exceed 55 lbs. Overweight bins will incur additional storage fees equal to the cost of one bin per month.
  • Pack bins securely and not include prohibited items.
  • Be present or provide safe access at scheduled times. If bins are left outside, you accept all risk of loss or damage before pickup or after delivery.
  • Reschedule missed pickups at your cost. The original fee will not be refunded.
  • Notify us of address changes at least 48 hours in advance.
  • Keep your contact and billing info current.
  • Report any damage claims within 48 hours of delivery.
  • Upload a description or photos of bin contents in the Binformation Center to qualify for reimbursement eligibility.
  • You may request up to 10 empty bins at a time. If you require more, please contact our support team.

We are not liable for damage caused by poor packing, prohibited items, negligence, or normal wear and tear.

6. Bin Ownership and Use

All bins remain the property of Bin There Bins. You receive a limited, revocable license to use the bins while your account is active. Lost, stolen, or damaged bins may result in forfeiture of the deposit.

7. Limitation of Liability

To the fullest extent permitted by law, Bin There Bins is not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid in the three (3) months prior to the claim. This includes losses from missed pickups/deliveries, data loss, or damage not covered under Section 8. Photos displayed in the Binformation Center are for reference only and may not reflect the exact condition of contents at any given time.

8. Customer Satisfaction Guarantee (Not Insurance)

Each bin includes up to $100 in limited, non-insurance reimbursement for lost or damaged contents. Bin There Bins is not a licensed insurer. This guarantee is offered solely as a customer satisfaction benefit.

To be eligible:

  • Upload a description or photo of bin contents in the Binformation Center before pickup
  • Report claims within 48 hours of delivery
  • Provide proof of value if requested

Destroyed bins will result in deposit forfeiture only. No further charges apply.

Exclusions: Electronics, fragile items, perishables, jewelry, cash, antiques, and similar high-risk items are not covered. We do not offer or sell additional insurance coverage.

9. Termination

We may suspend or terminate your access to our Services at any time, including for nonpayment, abuse, or Terms violations. You may close your account by contacting our support team.

10. Changes to Terms

We may update these Terms at any time. Updates will be posted on our website. For material changes (e.g., pricing, legal rights), we will provide at least 14 days' notice via email or through your customer portal. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of Davidson County, Tennessee.

12. Taxes

We collect and remit sales tax as required by law. Deposits are not taxed unless forfeited, in which case they may be treated as revenue and subject to tax in accordance with applicable tax laws.

13. Force Majeure

Bin There Bins shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, pandemics, labor strikes, civil disturbances, governmental actions, or unexpected operational delays such as severe weather or road closures.

14. Account Closure and Data Retention

Upon account closure, we may retain limited customer data and bin records for up to 90 days to process final transactions and for compliance purposes. After this period, digital content (including uploaded images or inventory descriptions) may be permanently deleted.

15. Privacy and Data Use

You consent to our use of uploaded images and bin descriptions solely for operational and claims purposes. We do not sell or share your content data with third parties, except as required by law. 16. Communication Consent

By using our Services, you consent to receive service-related communications via email, SMS, or push notifications. You may manage preferences via your account settings.

17. Intellectual Property

All trademarks, logos, software, and content made available by Bin There Bins are our exclusive property. You may not copy, modify, distribute, or use our intellectual property without prior written consent. Uploaded customer content remains your property, though you grant us a limited license to use it for providing the Services.

18. Third-Party Services

Our Services may integrate with third-party tools and platforms. We are not liable for any loss, damage, or unavailability caused by such third parties, including delays or failures in service. Bin There Bins is not responsible for the performance, availability, or privacy practices of these third-party services.

19. Dispute Resolution

Before initiating any legal proceeding, you agree to first attempt to resolve the issue informally by contacting our support team. If no resolution is reached within 30 days, either party may pursue formal legal remedies as set forth in Section 11.

20. Survival

Sections relating to Limitation of Liability, Customer Satisfaction Guarantee, Governing Law, Taxes, and Customer Responsibilities shall survive account termination or discontinuation of Services.
